Welcome to Syndicated, a TV show and episode tracker. These Terms of Service (“Terms”) are a legal agreement between you and Kurt Metz, an individual based in Colorado, USA (“Syndicated,” “we,” “us”) governing your use of the Syndicated mobile app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
You sign in through our authentication provider, Clerk. You are responsible for the activity that happens under your account and for keeping your login credentials secure. Let us know promptly at [email protected] if you believe your account has been compromised.
Syndicated lets you search for TV shows, build a personal library, track watched episodes and rewatches, rate and like episodes and seasons, and see what to watch next and what’s upcoming. We may add, change, or remove features at any time. The Service is provided free of charge; if we introduce paid features in the future, we will provide the applicable terms at that time.
You agree not to:
The tracking data you create (your library, watch history, ratings, likes, and favorites) belongs to you. You grant us a limited, non-exclusive license to store and process that data solely to operate and provide the Service to you (for example, to sync it across your devices and compute your statistics). We handle it as described in our Privacy Policy.
Show and episode metadata such as titles, descriptions, artwork, air dates, and cast is provided by TheTVDB and is subject to their terms. This metadata is provided “as is” and may be incomplete or inaccurate; air times in particular are approximate. Metadata provided by TheTVDB. Syndicated is not affiliated with, and does not host or stream, any of the shows it lists.
The Service itself, including the Syndicated name and logo, the software, and its design, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission. All rights not expressly granted are reserved.
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service, we will give notice and keep data export available as described in the Syndicated pledge. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) will survive.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any metadata will be accurate or complete.
To the fullest extent permitted by law, Syndicated and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100) or the amount you paid us in the preceding twelve months, whichever is greater. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Syndicated and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of any law or third-party right.
If you download the app from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with the Apple Licensed Application End User License Agreement (EULA), which supplements these Terms.
If you download the app from Google Play, you acknowledge that these Terms are between you and us, not Google, and that Google is not responsible for the app or its content. Google has no obligation to provide support or maintenance for the app. Your use of Google Play is also governed by the Google Play Terms of Service.
Where an app store’s own rules conflict with these Terms, that store’s rules control for downloads made through it, and only to the extent of the conflict.
We may update these Terms as the Service evolves. When we make material changes we will update the “Last updated” date above and, where appropriate, provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Colorado, unless applicable law provides otherwise.
